Abercrombie & Fitch tried to appeal a $115,264 fine to the Minnesota Court of Appeals, and sent its notice of appeal by first-class mail. The rules of appellate procedure, however, require the notice to be sent by certified mail or hand-delivered. As a result, the Minnesota Court of Appeals tossed the appeal, and Abercrombie paid the fine.
